Protecting the privacy and personal data of those who use our services is a key area of our business.

Helpee Ltd with its registered office at 136 Sandon Road, B66 4AB Smethwick United Kingdom as a Data Controller is required to comply with the so-called "UK GDPR" - which is the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), which is part of the legal order of England and Wales, Scotland and Northern Ireland due to section 3 of the so-called European Union (Withdrawal) Act 2018. 

It should also be noted that due to the fact that Helpee Ltd with its registered office at 136 Sandon Road, B66 4AB Smethwick United Kingdom does not have any business units in the European Union, it is also obliged to comply with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter "GDPR"), if the processing of personal data of persons residing in the European Union occurs in the course of the provision of services, and this on the basis of Article 3(2) of the same Regulation.

In consideration of the foregoing, Helpee Ltd with its registered office at 136 Sandon Road, B66 4AB Smethwick United Kingdom has adopted this Privacy Policy.

The definitions used in this Privacy Policy will be understood in accordance with the meaning given to them in the Terms of Service dedicated to the Customer and in the Terms of Service dedicated to the Specialist/Therapist, located at the following address: https://helpee.uk/privacy-policy
 

  1. PROCESSING OF PERSONAL DATA OBTAINED DIRECTLY FROM THE DATA SUBJECT.

Pursuant to Article 13 of the GDPR and Article 13 of the UK GDPR, where personal data are collected directly from the data subject, the Personal Data Controller is obliged to comply with the so-called information obligation towards the person from whom it has received the data. 

In view of the above and having regard to the generally applicable legal provisions relating to the processing of personal data, acting pursuant to Article 13 of the GDPR and Article 13 of the UK GDPR, the Personal Data Controller informs that:

  3. The Controller indicates that it will process your personal data in the scope, for the purpose, taking into account the legal basis, and for the period as indicated in the list below. The Controller also has specified in the list below whether the provision of personal data by you is mandatory or voluntary and what the consequences of failing to provide personal data are. 
  • Purpose: contacting the Controller by the Specialist/Therapist prior to entering into a collaboration agreement, including asking questions

  • Purpose: creating an account for a Specialist/Therapist on the platform at: www.helpee.uk and managing this account

  • Purpose: creating and managing an account for the Specialist/Therapist on the Google Workspace platform
    Data: name and surname, e-mail address, phone number, photo 
     
  • Purpose: creating and managing an account for a Specialist/Therapist on the Stripe.com platform
    Data: name, surname, company name, business description, business address, residential address, date of birth, e-mail address, telephone number, PESEL, bank account number, scan of ID document and document confirming the residential address
     
  • Purpose: contact of the Specialist/Therapist with the Customer via contact form
    Data: name and surname, e-mail address
     
  • Purpose: creating an account by a Customer on the platform at: www.helpee.uk and managing this account
    Data: name, surname, gender, e-mail address
     
  • Purpose: booking an Appointment for a specialist session with a Specialist/Therapist
    Data: name, surname, gender, e-mail address
     
  • Purpose: establishing contact with the Controller by the Customer through the contact form on the platform at the address: www.helpee.uk
    Data: name, surname, gender, e-mail address
     
  • Purpose: concluding and executing a cooperation agreement with the Specialist/Therapist
    Data: name, surname, residential address, telephone number, e-mail address, bank account details 
     
  • Purpose: confirmation by the Specialist/Therapist of the Appointment for a Specialist Session
    Data: name and surname, e-mail address, phone number, 
     
  • Purpose: establishing, asserting or defending possible claims related to the concluded contract
    Data: name and surname, e-mail address
     
  • Purpose: making settlements with the Specialist/Therapist and the Customer
    Data: name, surname, residential address, bank account number

LEGAL BASIS: an agreement or action taken at your request to enter into an agreement (Article 6(1)(b) of GDPR/UK GDPR) - where your inquiry or request relates to an agreement to which we are or may be a party; our legitimate interest in processing your data to communicate with you (Article 6(1)(f) of GDPR/UK GDPR) - where your inquiry or request is related to our services

RETENTION PERIOD: until the account is deleted by you or by us; in addition, your personal data will be processed until the expiry of the period during which it is possible to assert claims - by you or by us.

OBLIGATION TO PROVIDE PERSONAL DATA: your provision of personal data is a condition for entering into an agreement with us and for answering your questions; failure to provide personal data will prevent us from entering into an agreement with you and from answering your questions.
 

  1. In the course of processing your personal data, no automated decision-making will take place which would create legal consequences in relation to you or significantly affect you in a similar manner.
  2. Your personal data may be transferred to the following categories of recipients:
  1. providers of legal and consulting services that support the Controller;
  2. providers of accounting and payroll services;
  3. service providers who supply the Controller with technical and organisational solutions or IT infrastructure which enable the Controller to manage our organisation (in particular ICT service providers, courier companies, maintenance workers);
  4. entities authorised under applicable law, especially courts and public authorities;
  5. persons you have authorised to exercise your rights.
  1. As the Controller of your personal data, we provide you with the right to:
  1. access your data;
  2. rectify (correct) the data;
  3. request erasure of data processed without justification;
  4. restrict data processing;
  5. transfer data to another data controller;
  6. object to the processing of personal data.
  1. In order to exercise your right, you should contact the Controller by means of any communication channel you select from among those indicated in item 2 of this Privacy Policy. The scope of each of the above mentioned rights and the situations in which they can be exercised result from the provisions of law, and the possibility of exercising the right will depend on e.g. the legal basis for using the data and the purpose of their processing.

Please be advised that if you determine that the processing of your personal data is in violation of applicable law, you have the right to lodge a complaint with the supervisory authority responsible for the protection of personal data, i.e. the President of the Office for Personal Data Protection.   3. If the processing of your personal data is based on your consent, you have the right to withdraw this consent at any time. The withdrawal of consent will not affect the lawfulness of processing performed on the basis of your consent prior to its withdrawal. In order to exercise your right, you should send the relevant information to the Controller by means of any communication channel you select from among those indicated in item 2 of this Privacy Policy.

The Controller points out that due to the need to link the Website at www.helpee.uk with external service providers such as: Google Meet, Google Workspace and Stripe.com, your personal data will also be processed by the providers of the aforementioned services. All information about the processing of your personal data by the providers of the aforementioned services is contained in the respective privacy policies, at the following addresses:

The providers of the aforementioned services may act as independent controllers of your personal data or as processors of your personal data on behalf of the Controller. The Controller collects and transfers your personal data because of your use of the Services linked to the Website to the entities identified above. 
 

  1. PROCESSING OF PERSONAL DATA OBTAINED IN A MANNER OTHER THAN FROM THE DATA SUBJECT.

The Controller informs that in connection with the Services provided, the Controller may also process the Customers' personal data that have not been obtained directly from the data subject. 

The Controller points out that in such a case it obtains the Customers' personal data directly from the Specialists/Therapists, in accordance with the provisions of the Terms of Service dedicated to Specialists/Therapists. This is because the Specialist/Therapist who previously worked with the Customer can add the Customer's personal data to the Website, which are then processed by the Controller until the Customer confirms whether or not he/she agrees to the processing of his/her personal data by the Controller. The Controller sets up the Customer's Account on the Website and then sends the Customer information about the transfer of his/her data by the Specialist/Therapist along with two links redirecting to the following declarations: 1) "I agree" - if he/she accepts the fact of adding his/her personal data to the Website and agrees to have his/her personal data processed by the Controller; 2) "I do not agree" - if he/she does not accept the fact of adding his/her personal data to the Website and does not agree to have his/her data processed by the Controller.

Having regard to the generally applicable legal provisions relating to the processing of personal data, acting pursuant to Article 14 of the GDPR and Article 14 of the UK GDPR, the Personal Data Controller informs that:
